BOBBAY AND WHITNAY BATTLE FOR CUSTODY! » Bobby Brown claims in a lawsuit that Whitney Houston has kept him from seeing their teenage daughter.

“I have not seen or spoken to my daughter since early June and I have no prospect of speaking to her anytime soon due to Whitney’s actions,” Brown declared in Orange County Superior Court filings released last week.

Brown has been trying to overturn a judge’s default judgment to nullify the couple’s marriage and grant Houston sole custody of 14-year-old Bobbi Kristina. During a court hearing in April, Houston testified that Brown was “unreliable” and that she didn’t need spousal or child support. Brown disputes her claim, saying he’s been involved in their daughter’s life and was her primary caretaker when the couple lived in Atlanta. When Houston moved to Orange County to undergo drug rehabilitation, Brown said he paid about $10,000 for his wife and daughter to stay at a posh hotel. “At the same time, I basically lived out of my car,” Brown said. In other court filings obtained by the syndicated entertainment TV show “Extra,” Houston disputes that she is keeping Brown and their daughter apart and says she “would like him to be involved” in Bobbi Kristina’s life. “Frankly, I needed to be divorced from him so that I could get my life back on track,” the singer said. EVE HAS LEARNED HER LESSON! » She’s been wearing her alcohol monitoring device for a month, but Eve said she can’t get used to the hefty ankle bracelet. “It’s the most annoying thing,” she told PEOPLE Tuesday night at Tao Nightclub in Las Vegas. “When they told me I was getting it on, I thought it was going to be like a beeper, but it’s like a pair of Bose headphones.” The 29-year-old rapper was ordered to wear the Secure Continuous Remote Alcohol Monitor (SCRAM) after striking a plea agreement for her DUI arrest in April. Eve will be allowed to remove the device on Sept. 8. At the Signature Apparel party for the Rocawear, Bellarock, and relaunch of Fetish, the SCRAM was hidden by her long, flowing pants.

Having to deal with a DUI in the public eye was “disgusting” enough, Eve said, but the hardest part: Telling her mom. “I’m still scared of her … [I] had to tell her before someone else told her or she saw it or heard it. I definitely learned my lesson,” she added. “It was a stupid situation, stupid decision. I did something dumb and now I’m paying for it … Don’t drink and drive kids.”

CRACKHEADS AND AWARD SHOWS … DO NOT MIX! » Amy Winehouse will not perform at the MTV Video Music Awards on Sept. 9, her U.S. record label confirmed to the Associated Press.

“In a continued effort to support Amy Winehouse’s well being, in addition to the postponement of her U.S. tour, all other U.S. appearances have been canceled,” Universal Republic Records said in a statement.

OWEN WILSON BACKS OUT OF MOVIE ROLE DUE TO SUICIDE ATTEMPT

WE ALL NEED TO PRAY FOR OWEN WILSON » Troubled actor Owen Wilson dropped out of a major movie yesterday in a sign that his suicide attempt could jeopardize his career. The decision to can his cameo in “Tropic Thunder” reportedly was made jointly by Wilson and pal Ben Stiller, the comedy’s director. The movie starring Jack Black, Robert Downey Jr. and Nick Nolte began production six weeks ago. Wilson was supposed to head to Hawaii soon for filming.

Wilson has been hospitalized since Sunday, when police responded to an “attempted suicide” at his home in Santa Monica, California. It appears Wilson did not overdose on pills as part of the attempt or have his stomach pumped in a detox procedure at the hospital. Access Hollywood reported last night, citing an unnamed lawyer, that Wilson slit his wrists but did not take an overdose of drugs. The New York Daily News later contacted a Wilson source who confirmed the actor did not take pills.

Wilson’s brother Luke and their father were seen carrying bags out of Cedars-Sinai Medical Center yesterday morning, but the hospital wouldn’t say if Owen checked out. The quirky 38-year-old has released a statement, asking for time to “heal.” But others, like ex-junkie rocker Courtney Love, have been more outspoken. This week, she blamed Wilson buddy British comedian Steve Coogan for Wilson’s downward spiral. Coogan’s spokesman hit back yesterday: “These accusations are unfounded, unhelpful and hurtful to all concerned.”
