The actor’s lawyers filed a brand new appeal Friday (Dec 17), asking the court to let him out of prison (temporarily) so that he can take his tax evasion case to the Supreme Court.

According to the documents — filed in Florida — Snipes wants the U.S. Court of Appeals to overturn a decision that denied him bail last week … right before he entered Federal Prison. Snipes’ lawyers want SUPCO to determine if Wesley should get a new trial because of alleged juror bias during his tax evasion case.

In other “jailbird news,” DMX was sentenced to a year in prison after he pleaded guilty to violating the terms of his probation.

The rapper, whose real name is Earl Simmons, failed to check in with his probation officer after was arrested back in November following a concert performance, and is headed RIGHT BACK to prison for the umpteenth time this year.

X just turned 40 years old Saturday (Dec 18), so it might be almost time for him to act his age :)

The actor, convicted back in 2008 on charges of tax evasion, began his 3-year prison term early Thursday afternoon (Dec 9) at a federal prison facility located in Pennsylvania. According to news reports, Snipes turned himself in just before his noon surrender deadline.

Wesley Snipes was sentenced to 3 years in prison in 2008 after it was determined by a jury that the “Blade” actor willfully failed to file tax returns over a 4-year period on a reported income close to $40 million dollars.

Snipes filed an appeal to overturn his conviction and to request for a change of venue to New York from Florida. In the appeal, Snipes also said he should have been considered for probation. That appeal, however, was denied in July.

Snipes made an appearance earlier this week on “Larry King Live” where he attempted to claim that he was innocent, and revealed that he was hoping a miracle of some sort would keep him out of bars. Snipes is best known for his roles in all of the “Blade” movies, as well as “White Men Can’t Jump” and “New Jack Swing,” among others.

Snipes, who is praying that he won’t have to turn himself in to a federal Pennsylvania prison this Thursday, told Larry King last night:

“We still have prayers out there, Larry, and we believe in miracles. Don’t send me up the river, yet. Any man would be nervous if his liberty was at stake,” Snipes told King when asked about going to jail. “Right now, I’m more upset and disappointed that the system seems to not be working for me.”

A judge has ordered Wesley Snipes to voluntarily surrender at a federal prison in Pennsylvania next week to begin his 3-year prison sentence for tax evasion charges. The “Blade” actor, on bail since his 2008 conviction, was ordered by the U.S. Marshal’s Office to report to the Federal Correctional Institution McKean in Lewis Run, Pennsylvania no later than 12:00 pm next Thursday (Dec 9).

In April 2008, a Florida judge sentenced Snipes to three years in prison for willfully failing to file tax returns from 1999 to 2004 on a reported $38 million income, which was generated from Snipes’ movie appearances in “Blade II,” “The Art of War” and “Blade: Trinity.” Federal prosecutors said that the actor escaped paying more than $15 million in income tax returns by sending money to overseas accounts at the advice of delinquent tax advisers.

Snipes’ lawyers argue that their client was unfairly convicted, and a new trial should be granted due to testimony from Kenneth Starr, a former celebrity financial adviser who has admitted to cheating wealthy and elderly clients out of tens of millions of dollars. A judge, however, rejected those arguments, and said that “the defendant Snipes had a fair trial; he has had a full, fair and thorough review of his conviction and sentence. … The time has come for the judgment to be enforced.”

Snipes didn’t go down without fighting though. Before he lost his appeal, the “New Jack City” actor received the support of several of his Hollywood friends including famous actors and Denzel WashingtonWoody Harrelson, and TV judges Joe Brown and Greg Mathis who all submitted letters to the judge on Snipes’ behalf. Defense attorneys also filed 39 pages of testimonials and Snipes’ high school friends and employees also sent in letters to help the 47-year-old actor’s case.

It’s unclear right now when Snipes, who had been granted bond while he appealed his conviction, would be required to report to prison and where he will serve his 3 year sentence.

Actor Wesley Snipes and his attorneys are hoping to be saved by the recent arrest of Snipes’s financial adviser Kenneth Starr. Starr was charged in May with securities fraud totaling $59 million after he stole from celebrity clients such as Snipes and Sylvester Stallone. Since his arrest, Snipes’ lawyers are asking judicial officials in Georgia to throw out a petition they made appealing Snipes’ tax evasion conviction.

In 2008, Snipes was sentenced to three years in prison on tax fraud charges, however, he later decided to get the conviction overturned. Now Snipes’ lawyers want to go a whole different route and file a new request to either dismiss the conviction or grant the “Blade” star a new deal!

Convicted actor Wesley Snipes has been granted permission by a judge to leave the country and spend three days in London to complete post-production on one movie, and spend eight weeks in Thailand to film another. The actor’s lawyers are currently in the process of appealing his February 2008 conviction of three counts of willfully failing to file his income taxes.

Back in late June, Snipes filed a request in federal court for permission to leave the country. His lawyers’ claim was that him not being able to do those movies would jeopardize his “future livelihood as an actor,” which in turn, would make it hard for him to pay Uncle Sam back.

Oh, okay, I get it! They’ll allow him to leave the country as a convicted felon just so that he can pay the government back. Makes perfect sense. As long as they can get theirs I guess. If this ain’t special treatment, I don’t know what is.

“Mr. Snipes will, of course, voluntarily return after his work on this film—as he has done each time he has been granted permission by this court,” defense attorney Daniel Meachum wrote in Wednesday’s filing, which was obtained by the Orlando Sentinel.

(Photo: Getty Images) 45-year-old Wesley Snipes was sentenced to 3 years in prison today by U.S. District Judge William Terrell Hodges. The actor has to serve time behind bars because he failed to file his tax returns, reports People.

“I’m very sorry for my mistakes and errors. I apologize to my family, the court and the community,” Snipes said as his wife looked on. “I’ve asked the court to show me mercy and the opportunity to make things right.”

According to reports, Snipes paid $5 million as a gesture of good will at the time of his sentencing, but surprisingly that’s not even half of what he owes. Prosecutors say that he owes close to $41 million in back taxes.

Snipes, who was convicted of three misdemeanor counts of failing to file a tax return on his income that amounted to millions of dollars. As he left the court room, he said: “I’m feeling great – a little confused, but great.” When asked if he is worried about going to prison, he replied, “I don’t know. It’s nice to be out here with you right now. We live in the moment.” He was acquitted of two felonies, including conspiracy to commit tax fraud. He was also acquitted of three misdemeanor counts of willful failure to file a tax return. Snipes now faces up to three years in federal prison, which is a lot better than facing a possible 16-year prison sentence, had he been convicted of failure to file taxes.

And speaking of “failure to file taxes,” another celebrity might be in trouble! Word on the sidewalk is that Fat Joe might owe over $150,000 in back taxes to the IRS.

EVA MENDES SEEKS HELP FOR “PERSONAL ISSUES” » What the hell is Eva Mendes doing in rehab? Yeah, that’s the first question that hit my mind too! Apparently the “Ghost Rider” actress checked into a swanky rehab facility in Utah a few weeks ago to deal with a supposed substance abuse problem. This is what her rep had to say:

“Eva has been working hard for the past year and made a positive decision to take some much-needed time off to proactively attend to some personal issues that, while not critical, she felt deserved some outside professional support. Out of respect for Eva’s privacy, we do not wish to discuss further details.”

Eva is currently checked into the Cirque Lodge rehab facility, which is also the same facility Lindsay Lohan checked into back in August 2007. The substance Mendes is being treated for has not yet been reported. Eva was just named Sexiest Actress of 2008 by Victoria’s Secret and will be featured in an upcoming Calvin Klein Fragrances advertising campaign, which will debut next fall. Mendes also just wrapped filming on two flicks, “The Spirit” and “The Women.”

Commissioner Reva Goetz stated that she found Jamie’s petition for conservatorship to be in the singer’s “best interest,” and that Jamie was a “suitable and qualified person.” The decision from the court also states that Britney’s manager, Osama Lutfi, is not allowed to see her. The ruling by Commissioner Goetz gives Mr. Spears the power to hire round-the-clock security guards to protect the singer, to bar people from her property in Beverly Hills, and gain temporary control of her assets.

Word on the sidewalk is that when Britney heard the news, she wasn’t particularly happy. “Nobody’s taking my house. Who is my family?” she screamed into a phone at one point, TMZ said. Britney Spears, whose home was robbed on Friday, is currently under psyche evaluation at the UCLA Medical Center. Her original 72-hour stay has been extended to 14 days.

BILL COSBY TO RELEASE A RAP ALBUM SOON … NO REALLY, HE IS! » Bill Cosby, who is very outspoken on his opinion of rap music, is set to release a Hip-Hop album called “State of Emergency,” which will be a sanitized, issue-oriented CD, reports All Hip Hop. Sources tell the hip-hop website that the actor, comedian and philanthropist will address issues like proper parenting, teen pregnancy, drug abuse, Black-on-Black crime and the dropout rate in America’s high schools. In 2004, Cosby said in a speech:

“Your dirty laundry gets out of school at 2:30 every day, it’s cursing and calling each other [the N-word] as they’re walking up and down the street. They think they’re hip. They can’t read. They can’t write. They’re laughing and giggling, and they’re going nowhere.”

Cosby’s album will not contain any profane language, nor will it offer any denigrating comments towards women. State of Emergency would be the 35th album for the legendary comedian, actor, who released his first album Bill Cosby is a Very Funny Fellow in 1963. Whether or not Cosby will work with rappers on his lyrical flow or his musical selection was not known at press time.
