Halle Berry recently won another round in the custody battle with her ex boyfriend, model Gabriel Aubry, over the pair’s 3-year-old daughter Nahla.

Apparently, Gabriel wanted to reverse a Los Angeles judge’s original court order than a nanny be present whenever he has custody of Nahla while the two are in Europe (Gabriel is in Spain taking care of Nahla while Berry is filming a new movie in Majorca), but the judge refused Gabriel’s request.

Although he’s allowed to spend 3 hours alone with his daughter and is allowed to take her to the park or out shopping … a court order states that a nanny must be present at all other times, including overnight stays.

Aubrey feels as though the nanny is intruding on his relationship with Nahla, and doesn’t like how his every move with his own daughter is supervised by some Nanny, while Halle and her new boyfriend Olivier Martinez get to spend solo time with her whenever they please.

Berry and Aubry have been going at it over the custody of their daughter ever since they broke up in the Spring of 2010 after spending 5 years together.

Aubrey has been accused of neglecting and verbally abusing Nahla, which probably explains why his visits with her must be supervised.

A particularly bitter blow-up occurred in February of 2010 according to the quoted witness. Berry returned from a trip and found Aubry at her home and told him to leave or she would call police.

He screamed that she was a ‘’ghetto n****r’’ and threw a chair against the wall,’ the witness is quoted as saying. ‘Halle was shaken and sobbing.’

The incident was not unusual, according to the witness.

Gabriel hated that Nahla was mixed race,’ a colleague of Halle’s claimed according to The Star. ‘He never wanted her hair to be braided, and he always said that Nahla was white.

Friends tried to get him to understand that being mixed was part of her and Halle’s heritage, but he wouldn’t hear it…’

No wonder Halle doesn’t trust him alone with their daughter. What is his problem?

Hollywood Goddess Halle Berry and Gabriel Aubry left the L.A. County Courthouse earlier today after trying to finalize a custody settlement with the judge. Judge Mark Juhas said to Gabriel and his lawyers, “We’re making huge progress.  We need to stick with it.”

Halle and her high priced team of legal sharks, Neal Hersh and Judy Bogen, went into chambers to talk with the judge. Before that, Gabriel and his linebacker corps of lawyers, Gary Fishbein and Kristina Royce, also paid a visit to “His Honor’s” chambers.

Reports suggest that is all part of a settlement conference over Nahla‘s custody and visitation.  The major stumbling block has been Halle’s acting schedule, which takes her out of town from time to time.

From what happened this AM, it looks like Halle and Gabriel are on the verge of an agreement/truce. And we can’t blame him because that woman is FINE! How can a man not agree to anything this beauty offers?

Gabriel has been in the middle of a heated custody battle with Nahla’s mom, his ex Halle Berry, but now things are on their way to being resolved. The latest news between the former couple is that Halle was granted to take Nahla with her to New York City, where she’ll be filming a new movie.

Halle Berry and Gabriel Aubry are waving their white flags at each other in the wake of their bitter (and very public) custody battle over their 2-year-old daughter Nahla. Well, at least for now.

While the couple hasn’t exactly “kissed and made up,” a source tells Radar Online that they aren’t at each other’s throats anymore either, and that’s a development that’s good for everyone involved in the situation.

Halle is not going to seek sole custody of Nahla, the source says, adding that legal threats have been flying behind the scenes.

Several negative items about Aubry have appeared in the media recently, and Halle released a statement through her rep, saying she was “concerned” for her child’s well being while she was in Gabriel’s care. Other accusations, attributed to friends of Halle’s and a former business partner of Aubrey’s, were that Gabriel had used the ‘N word’. One report said he was verbally abusive to the 44-year-old Oscar winning actress during their five year relationship.

“I think Halle started realizing that things were getting out of control,” the source tells RadarOnline.com. “It was just getting too nasty and too public.”

Sources say that neither Halle nor Gabriel want to fight this battle in public. They stopped talking to each other as the war hit its most intense peak but now they have resumed speaking again.

“Gabriel has not responded to the allegations that have been made against him,” one source told RadarOnline.com. “His thing has always been that he will save the truth and fight, if needs be, in the privacy of family court, where no cameras or press are allowed. Gabriel and Halle even resumed talking again last week, and it seems that Halle is going to be making it easier for Gabriel to spend time with Nahla, which has been a sticking point between the two up till now. Hopefully this is the start of the two of them being able to form some kind of workable co-parenting relationship for the sake of their daughter.”

At this point, Halle is still determined to do whatever it takes to make sure her daughter is fine, but she also wants her disagreement with Gabriel to be contained within a closed courtroom when that time comes.

On Interracial Dating
Well, first thing I want to say is that I’m very connected to my community, and I want Black people to know that I haven’t abandoned them because I’ve had a child with a man outside of my race and I’m dating someone now outside my race who is Spanish and French. I have never been more clear about who I am as a Black woman[...] And who I really am is a Black woman who is struggling to make my race proud of me, who is struggling to move Black women forward in the profession I’ve chosen, and those relationships have actually helped me identify more clearly[....]The truth that it’s taken me a long time to learn how to love myself, and color isn’t really a part of what I look at when I’m deciding who I want to spend time with. I look for the soul, the person, the evolution, what he believes in, who [he is as a person] and how does it affect me in a positive way.

On if she feels like her beauty is a burden
No. I mean, beauty is subjective. [And] there are worse things people could say about me. I do wish people would notice other things about me.I wish people would talk more about my talent than they do my beauty. The custody battle between Halle Berry and her ex boyfriend Gabriel Aubry gets worse and worse as the days go on and more stories come out. But several sources close to the Hollywood actress tell PEOPLE that things between the former couple got really bad around Christmastime.

Berry became alarmed, say the sources, when the couple’s 2½-year-old daughter Nahla became hysterical after Aubry came to pick her up for a visit a few days before the holiday. “She was crying and kicking and screaming,” claims one source. “She was hanging onto her mother’s legs so she didn’t have to go.”

According to the source, when Berry tried to calm down her daughter, Aubry grew impatient. “He got Nahla and forced her into the car,” adds the source, who says that Berry was extremely upset by the incident and that things between the exes – who had at one point been on friendly terms – immediately disintegrated.

Other sources close to Berry, 44, say a similar episode played out several subsequent times, including one incident in which Nahla appeared “traumatized,” according to a Berry source, after a visit with her father. They claim such episodes led Berry to fear for Nahla’s well-being. A rep for Berry had no comment on the claims.

It’s been a little while now since Halle Berry and Gabriel Aubry have been together, and they still seem to have conflict concerning custody arrangements for their 2-year-old daughter. Word on the sidewalk is that Ms. Berry has been making it pretty difficult for Gabriel to see Nahla. And we hear she’s going to make it even more difficult for Gabe as she plans to take baby Nahla with her to South Africa for 3 months to film a movie.

“It’s been pretty difficult for Gabriel to see Nahla the last few weeks,” a source close to the situation tells RadarOnline.com. “He’s really getting sick of it and it’s getting to the point where he is seriously considering his options regarding pursuing permanent custody. He refuses to give up rights to his daughter, he loves her more than anything and is determined to be a regular, full time fixture in her life.

“The latest issue is that Halle is due to move to South Africa during July, August and September to work on a movie and she wants to take Nahla with her full time. That would mean Gabriel not seeing his daughter for three whole months and there’s no way he’s going to allow that,” the source told RadarOnline.com

As you could probably imagine, Gabriel was not pleased with the thought of not being able to see his little girl for 3 months, so he requested that Nahla stay in Los Angeles with him until Halle returns from South Africa. But Halle wasn’t having that at all and their discussion got a little nasty:

“Gabriel requested that he be allowed to keep Nahla with him in Los Angeles but Halle wouldn’t let that happen, so the two reached a total stalemate and it started getting nasty, with both of them looking into entering a legal battle,” the source said.

Ultimately, the two parents were able to come to an agreement and Halle will actually pay for Gabriel to come with them to South Africa where he will be a full-time nanny of sorts and care for baby Nahla while Ms. Berry is working. And the two even plan on living under the same roof during that time for the sake of the little girl.

“In the end they reached an agreement. Basically Halle is going to pay Gabriel to be a kind of full time nanny and to come to South Africa for the three months she’s there, and to be Nahla’s full-time caregiver. Halle has a huge house that’s being rented for her and she and Gabriel are going to try to live under the same roof and get along for the sake of Nahla. Heaven only knows how that’s going to work out, as they haven’t been on the best of terms lately, but they do both love their daughter so maybe they can make it work.

“Halle has got a contingency plan though. If it doesn’t work out with them both living in the same property, she has agreed to rent a house for Gabriel near where she will be staying, and then he gets to look after Nahla all day while she’s working, and return to his place at night. It’s certainly not a conventional solution, but who knows, maybe it will work for them. One thing is for certain though – this definitely is not any kind of attempt at reconciliation. It is definitely 100% over between these two, and if it wasn’t for the fact of sharing a child together they would quite happily never see each other again.”

Looks like baby Nahla might be getting a little brother or sister to play with soon! According to the latest issue of Life & Style Magazine, actress Halle Berry is carrying her and boyfriend Gabriel Aubry‘s second child! A source tells the publication that Halle, who is 3 months pregnant, conceived through artificial insemination.

“Halle is overjoyed. The first time, she struggled so much to get pregnant and eventually conceived through in vitro fertilization. This time, the baby was conceived through artificial insemination. She’s just ecstatic to be pregnant again. She wasn’t sure if she’d have another baby, so she’s very happy.”

Halle’s people have yet to respond to this new story, but we should be hearing from them any day now. As with any pregnancy story/rumor, this could go 3 ways: (1) Denial, (2) confirmation or (3) complete silence. You can probably tell by now we’re used to this ;-)

Actress Halle Berry and her male model boyfriend Gabriel Aubry hired a sitter Thursday night (Aug 6) to take care of the little one so that they could hit the town of Los Angeles for a date night.

And if you’re wondering why Gabriel will always be “boyfriend” and never “husband,” it’s because they both feel as though they don’t need to attach themselves to each other for life and don’t want to deal with the baggage that most marriages bring along. Sounds like the heart of a woman scorned…
